Victoria Milan Faces Class Action Lawsuit Over Biometric Data Violations

A class action lawsuit has been filed against the popular discreet dating app Victoria Milan, focused on the platform’s alleged violation of Illinois’ Biometric Information Privacy Act (BIPA). The lawsuit, led by plaintiff Michael Massel, claims that the app illegally collected, stored, and used users’ facial geometry without proper consent.

Victoria Milan, known for its discreet dating services, requires users to upload a selfie for identity verification, which captures sensitive biometric data. According to the lawsuit, the company failed to inform users how long this data would be stored or the specific purposes for its collection, which is a legal requirement under BIPA.

Biometric data, such as facial scans, is permanent and irreplaceable, leaving users vulnerable to identity theft or unauthorized tracking if the information is compromised. BIPA mandates that companies must notify users in writing, obtain explicit consent, and outline data retention and destruction policies—requirements that Victoria Milan allegedly did not fulfill.

Massel seeks class action certification and damages for all Illinois residents whose biometric data was collected by Victoria Milan over the past five years. This case follows other legal actions in the dating industry, such as an April lawsuit against MatchGroup Inc., accusing the company of designing apps to foster user addiction – a clear sign that more attention is being paid to how dating platforms are operating, and whether or not they are complying with the legal limitations that they’re meant to follow.
